Terms and Conditions of Hire

  1. The Hirer is responsible for arranging pick up of the equipment on the due date OR pays an extension of hire from the due date.  Client will be sent a reminder on the week hire is due to expire and is responsible for arranging pick up. 
  2. A 1x month hire extension will be automatically deducted from your credit card or bank account (if direct debit) at end of day hire is due to expire unless client has arranged for hire unit to be picked up before hire is due to expire.
  3. Hirer agrees to provide drivers licence and credit/debit card as proof of identity and for equipment security purposes.  Credit card details may also be used to charge for hire fees, purchasing equipment or extending equipment hire. a) Personal information collected will be used and stored for the purposes of providing our services to you and in accordance with our privacy policy.  Please email info@fithire.com.au for a copy of our privacy policy. 
  4. a) Equipment must be returned clean and in good condition.  Any damage caused to equipment due to misuse or neglect of equipment will be the responsibility of the hirer and will be charged to hirers credit card.  This amount can be up to the full replacement cost of equipment, plus any delivery or removal charges incurred.  Equipment will be photographed on day of delivery and checked when unit is picked up or returned.

    b) Equipment must be stored indoors in a clean dry environment.  Equipment must not be stored outside under any circumstances.  This includes not leaving equipment outdoors under covered patios or verandas.  If equipment is found to have been stored outside the client will be responsible to pay for the full purchase price of the equipment.  

    Electric treadmills and other equipment can be susceptible to water damage.  Even if equipment is stored under cover, damage can be caused by moisture in the air.  Any damage caused by water or moisture will be charged to client’s credit card and client will be responsible for any damage incurred (including delivery and pick up charges) up to the full purchase price of the equipment.  

    c) If equipment is thought to be faulty please cease using equipment immediately and unplug unit from wall.  Please contact FIT HIRE and a service technician will attend to your repair.  Please do not attempt to repair or service equipment.  If equipment is repaired or serviced by hirer then contract will be terminated and hirer will be responsible for all charges incurred.  If you are unsure if equipment is operating as normal please call us.
  5. Careful attention should be given to the instructions regarding the correct use of the equipment. The Hirer accepts full responsibility for any personal injury resulting from the use of the equipment being hired. Should there be any doubt as to whether you should use this equipment, please consult your doctor before hiring. Hire units have a user weight limitation.  
  6. Change of address or telephone number should be notified immediately.
  7. Hire fee is not refundable. A credit will be given towards a different product or future hires.
  8. If the hirer does not return the equipment on the due date, and payment becomes overdue, collection action will commence. The company shall be at complete liberty, without notifying the hirer to:

    a) Charge costs and expenses against the Hirer’s Charge Card for outstanding hire fees until equipment is returned or full payment at the current market value of the equipment. 
    b) Charge legal costs and all other costs and expenses incurred in relation to or arising out of the recovery of the item of equipment by FIT HIRE (ABN 52314233078). 
    c) Declare said information to a credit reporting agency under Section 18E(8)(c) of the privacy act. 
    d) Charge hirers credit card for any damaged caused by hirer to equipment
  9. The company shall be at liberty to enter the Hirer’s premises, at FIT HIRE’S option, to effect necessary recovery of the hire equipment.
  10. The hirer agrees to provide credit card details to be held by the company for the duration of the hire period.  If hirer cannot supply a credit card, the hirer will need to pay a cash deposit that will be held in trust for duration of hire period and refunded at the termination of hire period.  If the hirer uses a debit card then the deposit will be deducted from debit card and refunded at the termination of hire period.  
  11. This Agreement includes GST in pricing definitions
  12. Except for those conditions and warranties implied by the Fair Trading Act, or the Trade Practices Act 1974 as amended from time to time, or other Sales of Goods or Consumer Protection legislation, which may not be excluded, the buyer hirer agrees that he/she has not relied on any inducement, representation or statement made by or on behalf of FIT HIRE (ABN 52314233078) in hiring or purchasing the goods and that there are no implied conditions or warranties herein and that in no circumstances will FIT HIRE (ABN 52314233078) incur any liability of any nature whatsoever in respect of or arising out of or in connection with any loss, damage, harm or injury whether special, consequential, direct or indirect suffered or incurred by the hirer, buyer or any third party.

The liability of FIT HIRE (ABN 52314233078) for a breach of any duty of care shall, in all cases, be limited as far as may be permitted by law, at the option of FIT HIRE to replacement of the goods or the supply of the equivalent goods or the repair of the goods or the payment of the cost of replacing the goods or of acquiring equivalent goods and suffered or incurred as a result of any such breach.
